This Privacy Policy describes the privacy practices of Cinematic Apps, Inc. (“Cinematic Apps,” the creators of Line Budgeter, and referred to as “Line Budgeter,” “we,” “us,” or “our”) and how we handle personal information that we collect through our digital properties, including our websites, our desktop application, and our knowledge base (collectively, the "Services").

1. INTRODUCTION AND OUR ROLE

By accessing or using our websites, installing or using the Line Budgeter desktop application, or accessing any services made available through the application, you agree that you have read, understand, and agree to be bound by this Privacy Policy.

Our Role (Controller vs. Processor): * As a Data Controller: When you visit our websites, create an account, or contact our support team, Cinematic Apps acts as the Data Controller. This Privacy Policy governs how we handle that personal information.

  • As a Data Processor: When you use Line Budgeter to create budgets and enter third-party personal data into the software (e.g., cast and crew names, union rates, contact details), you are the Data Controller of that production data, and we act solely as your Data Processor. The processing of that specific production data is strictly governed by our Data Processing Addendum (DPA), which forms part of our Terms of Service, rather than this general Privacy Policy.

We are committed to protecting your privacy in accordance with global data protection laws, including the GDPR (EU/EEA), the UK GDPR, PIPEDA (Canada), the CCPA/CPRA (California, USA), the LGPD (Brazil), and other applicable federal, state, and provincial privacy laws.

2. PERSONAL INFORMATION WE COLLECT

2.1. Information you provide to us

  • Contact data: First and last name, email address, company name, and professional title.

  • Account data: Username, password, and profile information you set to establish an account.

  • Communications: Information exchanged when you contact us with questions, feedback, or support requests.

  • Payment data: Handled by our payment processor, Stripe, relating to your subscription (we do not store full payment card numbers directly).

2.2. Information we collect automatically

  • Device data: Operating system, browser type, IP address, general location (city/state), and device identifiers.

  • Application usage data: Features used, session duration, and general usage patterns (we do not independently access or monitor your specific budget line-item data).

  • Location data: Used to verify license usage and ensure compliance with our terms of service.

  • Log data: Access times, pages viewed, and technical error logs.

2.3. Cookies and similar technologies We use minimal cookies for essential functionality (e.g., authentication, security) and analytics (e.g., understanding how users navigate our site). We do not use tracking cookies for cross-context behavioral advertising and do not sell user data.

2.4. Legal Basis for Processing We process your personal information based on: Contractual Necessity (providing the Services); Consent (where specifically obtained); Legitimate Interests (security, fraud prevention, service improvement); and Legal Obligations.

We use your personal information to:

  • Provide, operate, and maintain the Services and your user account.

  • Process payments and manage subscriptions.

  • Enforce security features, verify license compliance, and prevent unauthorized use.

  • Communicate with you regarding support, updates, and administrative messages.

  • Create aggregated, de-identified, or anonymous data for research and development to improve the software.

  • Comply with applicable laws, lawful requests, and legal processes.

4. HOW WE SHARE YOUR PERSONAL INFORMATION

We do not sell, rent, or trade your personal information. We only share it with:

  • Service Providers: Third parties that help us operate (e.g., Stripe for payments, AWS/Google Cloud for secure hosting, email delivery systems). These providers are bound by strict data protection agreements.

  • Professional Advisors: Lawyers, auditors, and insurers when necessary.

  • Authorities: Law enforcement or government authorities if we believe in good faith it is necessary for compliance, protection, or to respond to a lawful subpoena.

  • Business Transferees: Relevant participants in the event of a merger, acquisition, reorganization, or sale of our business.

5. YOUR CHOICES AND RIGHTS

Depending on your jurisdiction, you possess specific rights regarding your personal information:

  • Access/Update: Review and update your account information by logging into the Services.

  • Opt-out of Marketing: Unsubscribe via the link at the bottom of our emails. (Service-related emails cannot be opted out of).

  • Right to Rectification & Erasure: Request the correction of inaccurate data or the deletion of your personal account data.

  • Right to Data Portability: Receive your account data in a structured, machine-readable format.

  • Right to Object & Restrict: Object to or restrict certain processing activities based on legitimate interests.

  • Regional Rights: This includes ARCO rights for users in Mexico, and the right to opt-out of the “sharing” of personal data for users in applicable US states (e.g., California, Virginia, Colorado).

Note on Location Data: Location data collection is required for active license verification and cannot be disabled while using the Line Budgeter application.

6. DATA RETENTION

For data where we are the Controller (Your Account Info): We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected.

  • Account information is retained for the duration of your active subscription, plus 3 years after account closure for legal and dispute resolution purposes.

  • Payment records are retained as required by financial and tax regulations.

For data where we are the Processor (Your Production Budgets): The retention of third-party data you enter into Line Budgeter is strictly governed by our DPA. You retain absolute control over this data, and upon termination of your agreement or written request, we will delete or return this data in accordance with your instructions.

We implement comprehensive Technical and Organizational Measures (TOMs) to protect your data, including encryption in transit (TLS) and at rest (AES-256), multi-factor authentication for administrative access, strict separation of databases, and regular automated backups. While we use industry-standard security, no system is completely impenetrable, and we cannot guarantee absolute security.

Cinematic Apps is headquartered in the United States. Your personal information is primarily stored and processed in the US. When we transfer personal data originating from the European Economic Area (EEA) or the United Kingdom, we rely on legally approved transfer mechanisms, including the European Commission’s Standard Contractual Clauses (SCCs) and the UK International Data Transfer Agreement (IDTA) / Addendum, to ensure your data receives an adequate level of protection.

If you use Line Budgeter to process the personal data of your cast, crew, or vendors, our Data Processing Addendum (DPA) applies to that relationship. The DPA is incorporated into our Terms of Service and strictly outlines our obligations as your Data Processor, including our specific security measures, sub-processor lists, and your binding control over data deletion.

The Services are not intended for use by children under 16 years of age. If we learn that we have collected personal information from a child under 16 without parental consent, we will delete it immediately.
